Terms & Conditions

These Terms and Conditions (the "T&C") set out the conditions of sale via the webshop operated by the Service Provider. Acceptance of the T&C by the User is a condition of using the webshop and placing an order. The original Hungarian version is the authoritative legal document; the English version is provided for convenience.

3. Definitions

• Service Provider: Tóth István, sole proprietor, operator of the webshop.
• User: any natural or legal person visiting the webshop.
• Consumer: a consumer as defined by Section 8:1(3) of the Hungarian Civil Code (a natural person acting outside their trade, business or profession).
• Business: a person acting in the course of their trade, business or profession.
• Distance contract: a consumer contract concluded under a distance-sales scheme without the simultaneous physical presence of the parties.

4. Applicable law

The legal relationship between Service Provider and User is governed in particular by the following Hungarian laws:

• Act V of 2013 on the Civil Code (Ptk.)
• Act CVIII of 2001 on certain aspects of e-commerce services
• Government Decree 45/2014. (II. 26.) on detailed rules of consumer-business contracts
• Government Decree 151/2003. (IX. 22.) on mandatory warranty for certain durable consumer goods
• NGM Decree 19/2014. (IV. 29.) on procedural rules for warranty and statutory liability claims
• Act CLV of 1997 on consumer protection
• Regulation (EU) 2016/679 (GDPR)
• Act CXII of 2011 on the right to information self-determination and freedom of information (Infotv.)

5. Products in the webshop

The Service Provider offers professional-quality home pizza-making equipment (electric pizza ovens, dough mixers, accessories). The gross prices (in HUF, including VAT) are shown on the product pages. Only stock items personally inspected by the Service Provider are listed. Product photos are illustrative; minor variations may occur.

6. Ordering process

The User adds products to the cart, provides contact, shipping and billing information, and chooses payment and shipping methods. By pressing "Place order" the User makes an offer to conclude the contract. The Service Provider confirms the order by email without delay, no later than 48 hours; the contract is concluded upon delivery of the confirmation. If confirmation is not received within 48 hours, the User is released from the offer.

7. Payment

The User can choose between:

• Online card payment via Stripe Payments Europe, Ltd. (Dublin, Ireland). The Service Provider does not handle card data.
• Bank transfer to the account stated in the proforma invoice issued by the Service Provider.
• Cash on delivery at receipt, in cash or by card on the courier's device.

The price is always the gross price including VAT. Shipping is charged separately. Free shipping for orders over 250,000 HUF (within Hungary).

8. Shipping

The Service Provider ships within Hungary via MPL and FoxPost, and to the EU (AT, CZ, DE, HR, RO, SI, SK) via the Packeta and DPD international networks. The specific provider and fee are shown in the cart before order completion. See the shipping page for details.

The User must inspect the package in the courier's presence and request a damage report if applicable.

9. Right of withdrawal

Consumers have a 14-calendar-day right of withdrawal without giving reasons under Hungarian Government Decree 45/2014. (II. 26.). The withdrawal period starts on the day following receipt of the goods.

9.1. How to exercise

By post (Tóth István E.V., Moha utca 12, 6000 Kecskemét, Hungary) or by email (hello@pizzabarlang.hu).

9.2. Effects of withdrawal

The Service Provider refunds the full amount paid (including standard delivery costs, except where the User chose a more expensive option) within 14 days of receiving the withdrawal notice. The Service Provider may withhold the refund until receipt of the goods or proof of return. Direct cost of return shipping is borne by the User.

9.3. Diminished value

The User is liable only for diminished value resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

10. Statutory liability and warranty

10.1. Conformity (kellékszavatosság)

The User may make a conformity claim under the Hungarian Civil Code: repair, replacement, price reduction or withdrawal — within 2 years. In the first year there are no further conditions beyond notification of the defect; thereafter the User must prove the defect existed at performance.

10.2. Product liability (termékszavatosság)

For product defects the Consumer may, at their choice, make a product liability claim against the manufacturer within 2 years from the placing of the product on the market.

10.3. Warranty

Per Hungarian Government Decree 151/2003. (IX. 22.):

• 10,000 - 100,000 Ft: 1 year
• 100,000 - 250,000 Ft: 2 years
• Over 250,000 Ft: 3 years

Warranty for the Service Provider's products:

• EFFEUNO N3: 2 years consumer, 1 year business
• EFFEUNO Easy Pizza Pro: 3 years consumer, 1 year business
• Pistino P5: 3 years consumer, 1 year business

11. Complaints handling

Complaints: email (hello@pizzabarlang.hu) or post (Moha utca 12, 6000 Kecskemét, Hungary). Verbal complaints are examined immediately; written complaints receive a substantive reply within 30 days.

The Consumer is entitled to seek judicial resolution of the dispute.

13. Copyright

Content shown in the webshop (texts, graphics, logos, images, product photos, software components) are intellectual works of the Service Provider or the relevant rights-holders. Copying or distribution beyond ordinary web browsing requires the Service Provider's prior written consent.

14. Amendments

The Service Provider reserves the right to amend the T&C unilaterally. Amendments are notified by publication on the webshop; orders already placed are governed by the T&C in force at the time of order.

15. Closing provisions

These T&C are drawn up in Hungarian, and Hungarian law applies. Matters not regulated here are governed by the Hungarian Civil Code (Ptk.) and other applicable laws. The invalidity of any provision does not affect the validity of the others.
